Q: Do you have to live in New York?

No. Real Property Law § 442-g governs non-resident licensees, and it sets out how someone living outside New York can hold a New York licence. Non-residents consent to New York jurisdiction and to a process for service of legal papers, but residency itself is not a barrier. Residency and citizenship are two different questions, and people mix them up constantly. New York restricts neither.

Question 1

Does New York require US citizenship for a real estate licence?

Accepted Answer

Not since December 2022. Before then, the licence law required applicants to be a US citizen or a lawfully admitted permanent resident. That language was removed. As the Real Estate Board of New York summarised it, the law “no longer requires an applicant to be a United States citizen or lawfully admitted permanent resident.” You can confirm this the direct way: read the Department of State's own list of salesperson requirements. There is no citizenship line on it.

Question 2

What does New York actually require?

Accepted Answer

The full list for a salesperson licence: Be at least 18 years old Complete 77 hours of approved qualifying education Pass the school's proctored exam, then the New York State salesperson exam Be sponsored by a licensed New York broker Pay the $15 exam fee and the $65 initial application fee Meet the character and fitness standards — see criminal record and licensing Every item on that list applies identically regardless of where you were born. The full requirements page covers each step.

Question 3

Do you have to live in New York?

Accepted Answer

Question 4

What if you don't have a Social Security number?

Accepted Answer

The application form asks for a Social Security number or a Federal ID number. If you have neither, the documented route is to provide a written explanation to the Department of State rather than simply leaving the field blank. Practical advice: do not guess at this, and do not let a school tell you it is impossible. Contact the Department of State directly and ask what they need in your specific case, in writing, before you pay for a course. Get the answer from the agency that issues the licence, not from a forum.

Question 5

Does a licence mean you can legally work as an agent?

Accepted Answer

This is the question that matters most, and it is the one New York licensing law does not answer. A real estate licence is a state permission to perform a regulated activity. Authorisation to work in the United States is federal, administered by entirely different agencies, and governed by rules the Department of State has no part in. Holding one does not grant the other. Sponsoring brokers also have their own obligations when they bring someone on, and those obligations depend on how you would be engaged. This varies by situation and is exactly the kind of thing an immigration attorney answers properly and a website cannot.

Question 6

Does a criminal record disqualify you?

Accepted Answer

Not automatically. New York reviews convictions case by case rather than applying a blanket ban, and the analysis turns on the nature of the offence and its relationship to the licensed work. We cover this in detail on getting a NY real estate licence with a criminal record.

Question 7

What should you do next?

Accepted Answer

Confirm your own situation with the Department of State in writing if the SSN question applies to you. Do this before spending money. Talk to an immigration attorney if your right to work is unsettled. This is worth doing first, not last. Then start the 77 hours. The course is the same for everyone, and it is the longest part of the path. Prepare for the exam separately from the course. The course teaches the syllabus; the exam tests timed recall. Our free exam simulator and free printable study sheets cover that gap, with no account required. If English is not your first language, the study sheets are also available in Spanish, Chinese, Korean and Russian.
